Any cannabis plant that contains more than 0.3 percent dry weight Delta 9-THC would be considered non-hemp cannabis—or marijuana—under federal law and would thus would not have any legal protection under this new legislation. Secondly, the legality of derivatives, so long as they come from hemp and remain under the threshold outlined in the farm bill, were upheld by the 9th circuit court appeals in May of 2022 in AK Futures v Boyd Street Distro.
